Cover won't. The problem is that Cover is a corporation which has a different standard for contracts and legalities than ordinary people. Suing each individual person that breaks a contract or uses a copyrighted work without permission is a nightmare, so companies mainly focus on the biggest targets, especially rivals in the same or similar industry. Because of that, big corporations take extra measures to make sure they don't break any contracts or copyrights even if they easily could. It's why WinRAR can make money. Any normal person would just click "Close" on the license window, but corporations would rather buy a license for freeware than get into legal trouble. Regular people need permission to stream games too, but game companies don't have the time or resources to take down everyone who uses their game without permission (except Nintendo).

Honestly what even is the profile of people who want to become HoloEN members nowadays? There's so many options out there and whether you like it or not Hololive pigeon-holes itself on the idol category, and while there's many categories of idols even on the actual idol industry they will need to do idol shit at least yearly with the HoloFes, with singing and dancing and all that stuff that might be a deal breaker to a lot of people, so taking this into account who's left? Fans stopped being a good metric after multiple self-confessed Holofans have debuted on other agencies in the past year and a half due to Cover's slow as molasses approach to growing the EN branch outside of StarsEN, and money-whores doesn't make much sense unless they're a literal who because being an indie cuts the necessity to pay multiple middlemen (Youtube and Cover) and on the superchat and membership department NijiEN is no slouch when compared to HoloEN, with even some of the least popular members being able cash up a nice amount of pity bucks. Unless they're a staunch support of Hololive to the point they're willing to power through it like Nene and wait until the EN management stops being a bunch of lazy fucks or genuinely like the idol aspect and want to be part of it I can't see many indies out there willing to become corpo, so EN3 could be a bunch of outsiders.

It would be a little difficult at the start but it's not like online bands aren't a thing, and the band aspect is more about having a cohesive theme that the members can use outside of just kayfabe. It wouldn't be like the whole investigation thing from Myth that was pretty much dropped or the council of higher concepts of Council that was barely used outside of the chuuni lore. A band would have the members contributing to the songs and not be a bunch of singers with the arrangement being done by a third party for example, and when they finally have 3D they'll have an exciting thing to do outside of gimmicky shit. I don't know how many people here watched the 2nd Stars concert but the best moment was when the first gen came up as a band and actually played their instruments, so the same thing happening but on a HoloFes would be even more hype.
