You might be correct that they've used it that way but that's because they're not using it correctly. Tracing is literally drawing over it. It's a technique that you can use for various purposes, but don't claim it's an original work. Referencing is also copying, and people have been called out for that too. But just look at the two images of the designs and compare them. They're significantly different to the point that it would take MORE work to trace or even draw directly from reference, and then change it. Instead, what the artist probably did was use multiple references, including Shylily's design as one of them.

It's not like they're just out to copy someone and claim it as completely their own, they significantly remixed it, but it's still too similar for comfort. It's an anime girl themed after an aquatic animal so logically the design would feature the tail of that animal, aquatic things like bare feet and a Japanese influenced sailor type uniform, and design features common in female characters like big tits and long hair. You wouldn't need to have seen ShyLily to design a character with these parameters.
The floppy ears are where we start running into issues. The main issue being that floppy ears such as those on Lily and Lola are a feature found neither on aquatic creatures, cats, or anime girls and are much more akin to rabbit ears when rabbit is not expressly an influence on either design. So even if you accept the patently absurd explanation that both designs were created as sea creature/cat hybrids completely independently of each other, the floppy ears are a somewhat illogical design choice unique to ShyLily's design.
Personally I think it would be a massive waste of time and resources for Lily to address this at all and the most likely outcome would be Streisand Effect-ing Lola into becoming actual competition (similar to what Veibae did to her). However, if she were going to try and fight this either in court or in the court of public opinion that is exactly the avenue of attack I would use. The ears don't make sense even on Lily's design so there is no believable explanation for how that same illogical design element would also end up as part of another design, let alone one that already so closely resembles Lily.

I just checked one of her VODs and she even *sounds* like Lily.
Not just "she has a German accent," but very specific mannerisms and idiosyncrasies specific to Lily.
