In a perfect world every composition by every producer would be owned at least partially by them even after a deal, but that's a delusional world we don't live in and is one Ghostdata should know better than to expect is reality. >>70760697
I think NijiEN is trash and I really appreciate artists, but why do so many artists think this way? I see this so often and I just don't understand why, especially with artists that make music. Why do they think they get to own the things they create when someone commissions them to make something for them?
Do they think that John Williams owns the rights to the Star Wars theme and can just use it whenever he wants and make money off it without Lucasfilms' permission?
Why do they always think they own the music they make after a company hires them to make that music for them? They act like these companies are patreon contributors and are funding their personal projects. Did they really think the giant company just wants to support its favorite creators or something?

When I pay someone to paint my car, they don't get a portion of the sale when I eventually sell it. When I hire someone to paint my house, they don't get to upload pictures of my house to their social media unless I give them permission. I forget the exact details, but there was a tattoo artist who sued a celebrity because the celebrity posted pictures of himself on social media and the tattoo that the celebrity paid for was visible. The tattoo artist claimed that he owned the rights to that tattoo design because he made it and the celebrity couldn't monetize it, even though it was literally his own body. That shit is fucking retarded.

I have no problem with artists wanting more control of their work, but that needs to be agreed upon by both parties ahead of time. If owning the rights or being able to further monetize the things people pay you to make for them is that important to you, then you need to be clear about that in the initial discussion when you agree to take their money.

No, unlike you, I do not side with the parent who gave their child up for sex slavery so they could cross a border. Contracts exist for legal protections, which is why they are meaningless in cases where there's no one who would consider it legal to enforce it but the principle is the same for criminal deals. The person who signs a contract is never the victim, even if the person who wrote the contract should be executed.

I never said the contract was sacred in that it should be above the law. He would have had the children sold into slavery by their parents returned to their parents, and I would have their parents executed along with the people they sold their children to. Most contracts build-in the assumption that everyone's going to try to break the contract, that would be the stuff that I'd consider autistically enforcing even if the rest of the contract was illegal. That way contracts would actually be worth something, otherwise human interaction all comes down to hoping the other person isn't one of the 99% that are barely sentient retards.

They're referencing the broader setup of kurosanji's contracts aren't they?

>> No.70779824

I mean its hard to feel bad for someone so naive at least they got "exposure". Its probably this person being self taught, from the few classes I had when pursuing game art and design we had a few instructors talk about IP laws and how companies could fuck you and take everything a lot of advice about getting lawyers or being ok with getting nothing lol. I guess that's one benefit to a more formal education but its not really an excuse anyone that is in a space like that should know better. At least they learned the lesson, I'm assuming, early in their career. If it was late then I feel even less bad at a certain age you should just know these things or be able to intuit them.

the liver contract leaks showed that ks tries to set themselves up to have infinite scope for changing contracts at any time, so short of actually having a lawyer go through it and then outright refusing the contract unless it's modified, /nobody/ has ever read a 'true' contract from them

The only thing we know about kurosanji contracts is vtuber related (absolute dogshit contracts, they try to force you to sign it quickly and not contact lawyers) and whenever they have some sort of art contest all art submitted is considered theirs (This is called speculative work and it's in many fields. Yes, it's bullshit but you can just not participate). If they tried to force him to sign quickly then that should've been a red flag for him to back out. If he read the contract then he wouldn't have experienced this.
The thing is, doesn't he already have one song for Niji? He should already know that he gets no royalties and can't put it in his album?

>> No.70786212

He's either an idiot, or an attention seeker.
There's two ways to give someone the right to use your work that I'm familiar with; you license the work; they either pay royalties or a flat fee but you still retain ownership and thus are able to use it yourself or license it to someone else- or you relinquish ownership and get a fat lump sum up front, but whatever happens with it is no longer any of your business. Since kuroshitty owns it in perpetuity, he sold it off. He no longer has the right to say what can be done with it. That's how it's supposed to work. This dumb motherfucker went tl;dr- and complained on twitter once he realized after the fact he should've read the damn thing.

>> No.70787373

The contract would have to have something spicy in it for the grifter to bother with. The grifter has to at least have the appearance of being right to continue getting views, the artist is obviously in the wrong. Credibility matters for him.
