Certainly not as fun as 'Elira is a villainous puppet master that drove Selen to suicide', but it looks much more realistic.
TLDR: Legal and PR teams in niji are fucking retarded and completely misunderstood the intention behind the doc that Selen's lawyer sent

Anybody who has worked in any corporate setting at any point and has even a modicum of understanding of PR or communications would clearly see that this was a fuckup of applying an aggressive crisis management playbook to something that wasn't a crisis.

To honestly believe that a company the size of Anycolor, in a situation like this, would let North American vtubers wing a response from the hip because one girl is really really mad, is such an insane misreading of this that I don't even know where to start.

It's still a massive fuckup, but one that has a logical reason for WHY they would have made the decisions they did. More importantly, it doesn't invalidate or undermine the questions of mismanagement/preferential treatment/talents-as-pseudo-management that people have suggested beyond this specific PR nightmare.

>Elira and her clique of pseudomanagement are the ones handling the communication/translations, so they would be the ones to get the document that spooked them
>since they are retards and obviously not PR or law professionals, they misunderstand, panic and jump the gun
>they tell niji that they HAVE TO FIRE Selen right fucking now and the JP side that has depended on their translations so far believes them
>they write the termination notice and throw the book at her, firing her in under two hours
The timeline is way too fucking tight for anything else, there simply is no time for someone to first read the document (and forward it to the livers with enough time to "thoroughly review it"), translate the document into Japanese, send it to JP management and then get the immediate response to fire her right away. The only thing that makes sense is that EN side is working de facto independently and the people running the show there are retards and amateurs who don't have a clue about what they are doing.

I believe the rrat in OP about them misunderstanding and panicking, I also believe that the ones doing this mistake were Elira and her clique, who were acting as "management" on the EN side and thus had way more power than they should.

That's exactly why I said that it's possible for those elements to be true without then extrapolating that to believe that the response and strategy Anycolor made has anything to do with the feelings or responsibilities of Elira, or any other chuuba or base-level EN manager for that matter.

The legal and PR departments would've been brought in well before even a single public statement came out. It's pretty clear that for whatever reason Anycolor believed (or convinced themselves) that Selen speaking publicly and the document she sent them were one in the same, and so within hours of getting that document and seeing how scathing it is their PR response is to treat this like a crisis to be dropped on them at any moment, and to get in front of it first to get the first say and steer public opinion before the document is released. Again, a terrible misread, but one that a company with professional PR would actually make.

Same goes for why they would show Elira/Vox/Ike the document (or summaries/portions of it); because their PR team in crisis mode would also be coaching them on how to respond to and deflect the accusations that are surely going to be dropped on them at any moment.

This is a colossal fuckup and I'm sure everybody responsible in Anycolor's comms department is getting the axe, but it's one that still has logic to it.

There's an obvious rrat hiding in this that the comms guy either didn't realize or didn't want to stir up - Doki's lawyer was the one who suggested they send the private document to Niji. Doki's lawyer would have been the one in charge of communicating the purpose of that document to Anycolor legal. Doki's lawyer could have very easily made it sound like the document was the statement to be released.
In other words, Doki's lawyer fucking baited Anycolor into one of the biggest PR fuckups of the decade and ensured his client would win not just legally but in the court of public opinion by doing effectively nothing. I fucking kneel.

This would make a good point when talking about most big companies, but Anycolor didn't have enough staff working for NijisanjiEN from almost the get-go, since a big part of the original management meant for EN left to start selling NFTs before any of their vtubers even debuted, which makes more believable that members who could communicate with the japanese side would get more control inside the branch and so, lending more credibility to the GURRAT.

My hugest issue with the comms rrat is that it extrapolates based on a very limited sample size. The Gurrat is trying to account for an entire year+ worth of yabs. For the Comms Ratt, I remember it only limiting its focus to just a few instances.

I do believe the basics of poor PR and legal departments fucking each other up, that's a possible reality. However, factoring in hours upon hours of retarded worthless mistakes / dramas from Nijisanji, I'm inclined to believe there's more and I need to take my meds.

While I do agree with your main thesis, that yes it's plausible for both. I'm more inclined to believe the Gurrat because it explains so much more motivations and tries to make sense the fucking retarded business decision-making that NijiEN has done due to previous knowledge. Honestly, I do acknowledge the mental illness does taint some perspectives and memories of the yabs because /vt/ - however, this all felt way too personal. >The document that Selen sent us is the exact same as what she's told us she would go public with
it actually makes more sense. Again, Anycolor management/comms at this point would believe, or assume, that Selen dropping this document is imminent any moment now. You coach your talents on how to respond to the specific accusations that they will be named in, prep them for how to deflect and shift the blame back over to Selen, and try to control what you think is a crisis narrative.

And then when it turns out Selen had no intent to ever actually release that document and it was just for the lawyers and to negotiate her graduation, it turns out you just threw multiple ugly punches at a pacifist and told on yourself.

It's only a large amount of merch relative to the girls who are unpopular in Asia(everyone except Enna). Japanese company gonna be biased to the Japanese market.

>The emotional seething lists of crimes to slander terminated members
Because Nijisanji is a black company and their response to any perceived threat is going scorched-earth and sending out character assassinations.

>Scheduling the stream to slander her at the same time as her return stream
Realistically that stream time is just EN prime time. It's also the same timeslot Gura always streams the rare times she does stream. I don't really consider it malicious overlap unless they go out of their way to pick a niche timeslot like when Gura changed her stream time just to overlap Bijou. Updated timeline of events reconstruction, according to the GURRAT:
>NijisanjiEN was founded in 2020 with its own dedicated management team. Said team left the company to start a NFT venture in December of that year. Ex-NijiIN member Noor is then put in charge to fill their place.
>>/vt/thread/68273408#p68280109
>The first set of auditions resulted in 6 members being contracted, with only 3 debuting at first under Lazulight, one of those members was Elira, whose knowledge of the japanese language seemingly gained her the favoritism from the higher-ups early on, as indicated by the company letting her choose the theme for her second outfit while Pomu hadn’t such a benefit.
>>/vt/thread/69142853#p69147004
>Said favoritism also translated into Elira getting more merch released than any other member of Lazulight.
>>/vt/thread/68996770#p69009739
>The second set of auditions was for the third and fourth waves. The third wave is Ethyria, which contains two of Elira’s PL friends, Enna and Millie, indicating that they may have been hired through nepotism, a testament to the influence of Elira inside the branch.
>As the branch grew in members, Elira would need some sort of assistance to forward communications between it and the japanese side, and so Enna and Millie, became involved in the process to monitor and report her about the happenings inside the branch.
>>/vt/thread/69014403#p69023271
>>/vt/thread/69228845#p69246437
>Jumping straight to 2023, Noor is replaced with Yasuhiro Harry Igarashi as head of management for NijisanjiEN, somebody who treats this position as a part-time job, meaning that he is less involved with the branch than Noor, which left a power vacuum that Elira and her friends could monopolize for themselves.
>>/vt/thread/68033404#p68043182
>May 23rd of 2023, Selen misses the deadline for the recording of a voice pack and mentions wanting a representative so it wouldn’t happen again. Getting a representative would incite other members to do the same, making Elira’s role as a translator between the EN branch and Anycolor pointless. And so, Elira possibly proceeded to convince management proper (she’s ‘‘shadow management’’, a liaison, after all) to suspend Selen and have her given the warning that one more infraction would mean that she’s out of the company.

>In the months that followed, Elira appears to have done an internal smear campaign against Selen, trying to convince most of the members of the branch to get rid of her. And as such, would attempt to isolate Selen from the rest of the company as much as she could.

She mentions having read the legal documents about Selen/Doki’s case, which were meant only to be seen by Dokibird, her lawyers, and Anycolor’s management. The only way she could have gotten ahold of them it’s if she was involved with management herself. With her being the primary translator between members of the EN branch and the japanese higher-ups, it isn’t unexpected that the japanese would rely on her to translate the contents of the documents.

Take into account that each member have their side of their story and so, as they may come forward with their versions, there could arise contradictory or previously unknown details. Pomu's merch sold poorly in Asia. Most of her fans were westerners. Anycolor is poorly managed and didn't see the value in growing a genuine North American fanbase. They just saw all the opportunities for domestic promotion by putting Elira on billboards and in maid cafes in Tokyo and Taiwan and ran with that because it's the business they're familiar with.

>explaining everything as mistakes and coincidences is more insane than saying someone was making it happen but keep coping and seething
Trying to come up with conspiracy theories for how things ended up the way they are won't lead you anywhere. Life isn't always gonna fit neatly into your theories. Most of the time it genuinely can be explained by incompetence and laziness, because humans on the whole are incompetent and lazy.

If there really was some grand conspiracy masterminded by Elira Pendora I guarantee you Pomu would not be the one being victimized by it. She went on a private vacation to Antarctica with Elira AFTER all of this merch bullshit, that personally cost her like $50,000. They're literally hanging out in Japan right now too. Now what's more logical to you, that Pomu knows Elira had no control over who receives merch, or that Pomu remained friends with someone who sabotaged her career maliciously?

I don't know what would make it hard to believe that Anycolor's Japanese legal department and comms would be inflexible make this mistake of not shifting gears as the situation evolves. They stuck with the same assumptions, and same playbook, as they started the second they got that document from Selen's lawyer.

Again, they're really fucking bad at their jobs, as shown by how this thing turned out. Everything they did was clearly crisis management for a crisis they convinced themselves was happening.

Just trying to be a voice of reason here, the conspiracies about Elira holding all this power over the branch seem totally unfounded. This is a girl who streams like 9 hours a day 6 days a week, she doesn't even have time to meddle. There's definitely favoritism involved, but I find it hard to believe she was maneuvering behind the scenes to inject herself into things or cost other people opportunities. Management are just assholes who suck at their jobs, and Elira is a doormat who does anything they ask of her, which they like because it makes their jobs easier. Actually it's just a theory about office politicking that happens in any workplace.

I had a manager who got away with shit because he was fucking HIS manager. Let him be a verbally, and sometimes physically, abusive piece of shit until she wound up fired and her replacement threw my manager out within the month because while he tried to pretend to not be an absolute cunt, he couldn't keep up the facade.
Workplace politicking leading to workplace harrassment isn't a conspiracy theory.

Of course, even the low-earners should have merch releases every once in a while, but it just seems odd that someone who sells so much merch, gets so little merch compared to someone who sells less.
>They're literally hanging out in Japan right now too.

That's the thing, it's very very likely there is heavy favoritism towards Elira because she's easy to work with and never complains, and not because she's politicking behind the scenes. Pomu probably realized that her and Selen always fighting management for projects and forcing them to do their jobs got her a bad reputation internally, and it was hopeless trying to keep going because management would keep stonewalling her over petty office politics. That's not the main issue. You can still reduce it to favoritism of some kind and have it work out. The main issue is the extent claimed of said favortism and how far it went. The main issue is mainly on the economic side and embezzlement, that was never going to happen. We're talking about one of the biggest companies on the Tokyo Stock Exchange and a public company. They need to actually have their finances vetted by a third party accounting firm who can confirm the numbers are accurate and true, otherwise, they won't sign off on earnings and that has happened. I can believe incompetence and misappropriation of resources at best but anything further isn't believable and that's where it falls apart because the main advantage of the clique if it was true was the economic advantage it would be able to confer to certain members and not others.

If there is a competent expense reimbursement system in place, that should not happen as you need to provide receipts. But I would not put it past NijiEN to be incompetent at that, but it can't be more than misappropriation of funds that was intended for a broader purpose that ultimately had a narrow one because it would get caught by the said third party accounting firm. We aren't exactly talking about anything beyond several grand.
No one in the said clique is smart enough to explicitly try and violate public securities law by cooking numbers that hard to get the advantages the GURRAT supposedly espouses, it assumes that any of them are good at math at NijiEN in the first place, which given what we know about their math skills is laughable and they would be punished hard. Moreover, no one in their right mind would think that she'd micromanage 30 other organs. By now, she'd only be involved in high level affairs and delegate the rest. You know, like managers do

They may in fact now be caught

I only say that because the severity of doing so is too high for any rational person to do, this is explicit jail time and massive monetary damages territory not only for the company but for the individuals as well. Hanlon's razor applied here leads me to believe it's more incompetence rather than explicit malicious intent when outside of the clique behavior, favoritism and animosity towards Selen right up to the CEO response from Riku, we haven't seen any other signs or misgivings that shows bad behavior elsewhere that would lead me to think otherwise.

It would be fucking hilarious if this entire shitstorm was brought about because they refused to let her out of the contract and Selen's legal team bought a JP translator.

Read carefully, I said outside of what has been observed. Again, I question the degree of how much you can trust a narrative with no evidence that you keep extending with a priori evidence elsewhere vs rational human behavior. I rather side with human behavior here unless it can be proven otherwise with solid evidence and I will die on that hill.

then both doki and the lawyer should have explained what the doc was for.
imagine making threats about getting "lawyerd up" (allegedly) then sending them papers.
what the fuck would you expect nijis response to be?
if the lawyer said
>by the way, we aren't suing you.
>this is just her listing out her complaints and who was involved in the bullying
maybe they would have been like
>ah, soudesune~ we will "punish" our livers okay? arigato gaijinーsan

Those papers and her prior communication never stated the intention of suing. It was always about letting her quit under neutral circumstances. Underpaid lawstudents will make that mistake.

In their Legal & General Affairs hiring page :
・ Experience in studying for the bar exam or judicial scrivener examination, or at least 2 years of legal experience at another company, and a level of legal knowledge that allows you to handle regular legal work on your own after OJT (attorney qualification is not required)
So I assume their legal team got someone with "X years working legal at Y company/law firm " omitted( actual job was making tea & coffee , copy papers & bow down together with their boss to apologize whenever an angry client come over )
