no, it was because companies thought they were independent streamers. Indies can stream whatever they want as long as they add commentary.
Companies have to explicitly request permission to stream. Cover never requested shit and had been streaming for close to a year using copyrighted material.
Some company told them and they were smart enough to tell the girls to private everything (delete in subarus case rip) because if Sony or Nintendo had caught wind of this they would've deleted the whole channel with a phonecall.
