We've had a discussion about this before regarding another vtuber. Essentially, unless Zaion is living in Japan, she can join another agency and Nijisanji wouldn't be able to do anything about it (unless they bother suing her in her country, where her country's own laws on non-competes would apply).
Actually, even in Japan itself, enforcing a non-compete is not so clear cut, since the Japanese Constitution has a provision where people are allowed to switch jobs "to the extent that it does not interfere with the public welfare."

Either the non-compete is a separate legal document, or the clause has a stipulation that says the non-compete outlives the agreement it's on.

It doesn't matter if its enforceable or not, Nijisanji is a massive corporation with massive resources to sue her to oblivion. She was TERMINATED, meaning she likely broke the contract, and she probably knows that if they want to they can sue her to oblivion.

I highly doubt she will simply not be indie until this clause runs out, instead of risking being sued just because "They cant enforce it" or "they will lose in court". Courts are expensive, and most normal people would rather not get sued by giant corporation, especially for a small corpo like phase.

Most likely they'll sue Phase Connect for "Tortuous Interference" instead of Zaion herself (since Phase would be the one 'facilitating' her breaking of the non-compete).
Even then, AnyColor will still have to bother suing them over in Canada. Meaning that they'll have to hire Canadian lawyers, pay Canadian court fees, the whole nine yards. That's on top of all the press this proccess will be getting (good or bad). If AnyColor will be willing to risk all this, then Zaion would've had to screw them over really REALLY badly (like, for example, leaking Niji Discord logs, which she ultimately did not do).
In my opinion, they'll just let her go and be Phase Connect's problem instead.
