However, someone recolored Lola's model/reference (>>77368349) to prove a point and if it didn't have the note that says 'Recolor with Shylilly's Colors' in the corner, I flat out would've glanced at it and said "Ah, that's just Shylily". So I don't think it's at all 'legally distinct' if all that's really separating it is the color.

But you _can't copyright_ an accent or mannerisms--they're not "fixed."

The difference there is that those mannerisms are "fixed" in the cartoon, while the "mannerisms" (broadly construed) of a person aren't. Another difficult problem is clothing--the bulwark of the model--is difficult to copyright. Further, in this case it's clear that there's not literal copying--you can't literally see any of Shylily's model in the other girl's model--so to show copying you would have to identify the copyrightable parts of Shylily's model which are also in the new one. The key restriction here is "copyrightable"--copyright doesn't protect ideas, only expressions of those ideas. Because of this, to show that the copyright has been infringed you need more than big-picture points, you need specific, identifiable details. And things brings us back to what was copied--a humanoid VTuber model (which is certainly not unique nor original to Shylily), plus an aquatic animal-like tail (and markings on the body of the model) and some ears. But the most promising places for details--the tail and on-body markings--are clearly differently designed. Again, the idea has clearly been copied, but the expression is completely different. Most of that is trademark stuff, though--"overlap in market" particularly. Obviously, when you have the same "idea" in copyright you'll be in more or less the same market focused at more or less the same audience.

This is more right-of-publicity stuff, though, especially when you're dealing with IRL people (like companies getting voice and face stand-ins for actors playing hard-to-get). I guess this is where it gets a little tough in the law because there's not really a clear precedent here. How much of a VTuber's persona is fictional? At what point does it pass from a unique vocal performance to a normal speech in an unusual accent? Does it matter? What even is a character in the first place? I hate philosophy, so I don't want to answer these questions. I will look more into the copyright caselaw for it, though.

To be fair there is alot of incompetence at play, but that's mostly due to it being run by volunteers and the inexperienced rather than outright sabotage.
