A vtuber is more than just a model, a vtuber's "identity" is a combination of a model, voice, personality, and mannerisms. Megalodon is obviously a shylily copy in terms of her visuals, but her personality and voice are absolutely not copies of shylily.
A big part of copyright legislation for characters is that they need to be distinct in terms of personality. I cannot make a cartoon of a red sponge and have the character act identical to how spongebob acts, but I can make a cartoon of a red sponge and have it act completely different from spongebob.
In the case of the girl in the OP, she is not only cloning shylily's model (some parts look like a 1:1 trace even lol), but she is also copying the voice and mannerisms of shylily as well.

Copyright can't be used to protect things like ideas and arrangement of design elements. It only protects the specific execution of those ideas and design elements. Protecting character for big companies versus fanart works like this, you can make derivatives of their characters under a fan license. On the other hand, they can't claim that every similar character is derivative, this is much harder to prove and silhouette tests and recolor tests are just zoomer autism. If silhouettes were actually important to the extent people are saying then you could only have one human character in a suit, or they could only keep one distinct pose throughout their existence. It's a retarded argument.
In short there is nothing Shylily can do to protect herself from copycats, and to some extent her character design is a copy of existing character designs. The reason Shylily can use her model without being sued is the same reason that others can design and use characters similar to Shylily.
