Since this statement was obviously false, can Riku be sued for lying to investors?

Selen was terminated February 5th, and Q3 ended January 31st. In other words, that was how much EN's revenue had dropped BEFORE her termination, the Q4 report due in a couple weeks will show what happened since then.

This is true if you look year-on-year, but if you look quarter-on-quarter there was a big drop between Q3 and Q4 2023 and a slow decline since then. We don't know what the Q4 results will look like but if sales correlate with viewership we can estimate a drop of around 33% quarter-on-quarter and 55% year-on-year

Would be true if they hadnt lost 3 big earners with Kyo, Pomu and Selen.
Vivi and Kunai certainly arent anywhere near making the same money and I dont expect the 3 new ones to do that either.
So we have 6 new talents and even together they probably wouldn't make the money lost just for Pomu alone.
I am gonna be bold. They could have new talents and it wouldnt bring in as much money as Selen and Pomu did.

> Promotion
They were supposed to have a Hyte collab but Hyte cancelled it so it may take a hit
> Event
This shit has always been 0 and it could have stayed that way until the Selen situation forced Riku to release AR live and hope this metric will fill the gaps
> Commerce
I'm guessing this is about merch and I don't know whether sisters would spam support for EN in harsh times by buying merch or not, but there will definitely be a decrease
> Livestreaming
LMFAO. This shit will be cut by at least two thirds or worse due to the sub culling and the huge decrease of CCV

In conclusion, expect the yellow block to fill half of the total Q4 block, but I bet the Q4 block will be shorter than Q3 by at most half because of the other factors (unless sisters somehow saved them with increase of merch selling)

Technically, NijiEN’s revenue was already in free fall before Selen was terminated, so it’s not like it was actually untrue per se.

I mean, the Q3 was fucked beyond repair, but the Selen SHOKU had a direct impact on how much the stocks died.
>No one expected the Q3 to be THAT bad
>The Q4 is usually pretty damn weak, but Anycolor said that they were betting everything on it
>All of this while NijiEN was literally burning down
The stocks would have taken a hit regardless of what happened to Selen, but her termination made everyone understand that NijiEN doesn't have any future.

4 months ago, Anycolor did a buy back and the stock price rose up and it had stayed that way for at least 3 weeks with no signs of going down. But just so happens that on Feb 5 that their stock took a massive nosedive, then the Q3 report took them down even further and it doesn't seem like it will go back anytime soon

In fact it got so bad that they reached their NEW LOWEST in Anycolor history now that they passed below 2.1k mark, and that's when we still have 2 more weeks till Q4 drops

What event happened on faithful Feb 5 ? Selen termination notice. Is that just a mere coincidence ?

A factually untrue statement is not a lie if the person making it is genuinely delusional enough to believe it to be true. Honestly, that doesn’t look good for Riku either, but it might work in the absence of hard evidence that he knew it wouldn’t be negligible. Also, the Q3 report and its aftermath were bad enough that the rules of the TSE don’t allow them to fall as far when Q4 hits, barring a sustained panic. Riku better hope the weekend after the report drops will save his ass again.

Thing is, they didn't have anyone to REPLACE those 3 when Q4 was going on. At the very least they had Kyo still streaming until his graduation in late February, but even then that's not gonna help replace the lost revenue not just from losing two of your top female talents but also many of your talents going into hiding.

Oh there's no doubt that he'll engage in some sort of chicanery to try to hide EN's failure from the investors.
The catch is that he has to do it through 100% legal means. Because as bad as the damage to the company has been thus far, it would look like a slightly damp fart compared to the damage that would happen if they get caught running afoul of Japanese securities laws.

That one event delayed/cancelled last year and done this year.
I dont know about the legalities if the tickets were meant and sold for the event last year but if they add it to the finances for this year as they have delayed/brought it back this year.

in western corporate accounting, you'll see companies recognize that revenue in a variety of ways depending on the circumstances. what's important is to have a consistent practice for how you count it, and make goddamn sure you only count it once.

Being wrong about statements is not a crime. It is a crime to purposefully mislead investors. The word negligible is doing a lot of heavy lifting here. Losing your largest female liver in a sub branch and knowing about a major HR complaint and hospitalization (thus, possible major incoming PR issue, and possible legal action) is stretching things quite a bit. You would probably need to pair it with proving that they are knowingly misleading investors rather than just being completely incompetent. For example, pairing it with an executive selling off stock before it blew up. Which I don't think happened?

I feel confident to testify this statement is false in a fucking court of law, but japanese are too cucks to do anything, they will at best fire Riku if he resufes to do dividends or another buyback. They literally don’t care if the yacht is sinking if their lifeboats keep receiving gold and the sis are too retarded to acually demand any quality.
