Capcom copyright striked Mio twice, and as a result Cover adopted a policy of only streaming games where they have a signed legal agreement from the publisher that they can stream them without that happening. This was proven to be the correct approach after Mages copyright striked a holostar for streaming one of their games, and Cover counterclaimed and got it reversed with the permissions fax, leading to the dev having to publicly formally apologise (twice, because they spelled his name wrong the first time).

Thing is, they rather not make streams that could be blocked in multiple, if not the majority of the countries their fanbase are.

The US is the most permissive regime for copyright, and the general consensus there is that fair use would not cover video game streams because just adding commentary for entertainment purposes is not sufficiently transformative.
This hasn't been tested in court, but that's because Google and Amazon effectively get to make that decision before it gets there, and they say it's not (and their lawyers are certainly paid well enough to make a reasonable guess).
Most other countries either don't have fair use at all (e.g. Japan) or define it too narrowly to apply to video game streams (e.g. in most of Europe it only applies to journalism and education).
