I don't watch Holo or Niji, what is the difference between Mel's situation and Selen's? From an outside pov both girls technically broke a rule in the eyes of their employers right?
Is it more like people are mad over the way one company handled their situation compared to the other?
Is there a difference in degree of "fairness" regarding either mistake and its commensurate punishment?

The difference is Cover aren’t going to try and save face and throw talents under the bus. Mel isn’t even a good comparison, her channel is still up despite termination.

looking at the replies here makes me glad that I sticked to holo honestly.
Ofc hololive has its fair share of drama even before, and their management was also dogpiled from what's been transpiring on coco's channel because of that west taiwan shit.
But what did they do? they improved themselves and actually hired competent and experienced managers now, not some random highschooler unlike anycolor.

And eventhough most anons here complain on how much breaks some holos take are too long, look at how it improved the experience for the talents.

The difference is they kept fans in the dark about her for 2 months, Skinwalked her twitter to assure her fans, And then the VERY FIRST THING they do to resolve this is to release a 3 page long termination notice out of no where that contradicts itself repeatedly while defaming and smearing selen as an uncooperative bitch who threatened to sue them for fake reasons all the while they Admit to harassing her while she was in the hospital for a suicide attempt, Causing her to have to respond to all of this in a hasty manner, THEN they release a statement calling her termination "financially negligible" prompting many people to rightfully assume they see their talents as money machines as opposed to hololive's (seemingly) genuine care for the talent's wellbeing

Then you have Mel's termination, Where she admitted to her wrongdoing, was ALLOWED TO APOLOGIZE ON HER ACCOUNT, and had multiple members of staff INCLUDING YAGOO HIMSELF lamenting her loss and wishing her well in her future endeavors, Basically parting in extremely amicable terms

Mel fucked up, Cover had to terminate her because it'd set a precedent otherwise, she understood that, they both agreed that was the only course of action.
Fans sad, but they accept the decision like their oshi did.

Selen was harrased into attempting, the company publicly stated she was irrelevant, constantly put out conflicting statements regarding the whole situation, other organs went live trying to use their "influence" to make out Selen to be the bad one while also giving her lawyer the biggest boner of his life. CEO came out with a statement begging for investors to stop pulling out.
Fans angry, and with a good reason.

Mel broke a non-disclosure agreement stipulated in her contract and was terminated from that contract as a matter of course. The company acknowledged in a public statement that it valued her and regretted the necessity of the termination and allowed her to make a public statement bidding farewell--in which she willfully admitted to her wrongdoing, leaving on the best possible terms for somebody that broke red line contract terms. Talents were free to comment on the situation and most of them expressed positive opinions of Mel and said their goodbyes on good terms. Overall her sendoff was extremely positive for someone who was being fired for breaking rules and emphasized the value the company places in its talents.

In the past Mel had suffered harassment from Hololive's management and had been forced to lawyer up to protect herself, but the company took the complaint seriously, allowed her paid time off to deal with things privately and terminated the offending employees, launching an extensive internal review process that transformed the company and its management approach to better protect talents in the future. Several years later we can see the positive impact those reforms had on the company and its relationship to its employees.

Selen suffered bullying and abuse both from other talents and from management itself for years while the company repeatedly refused to engage with her official HR complaints about the above. She was the victim of targeted harassment aimed at disrupting a company-approved but self-funded project under dubious pretense and violated Nijisanji's internal protocol (but not contract terms) by releasing her project unilaterally and encouraging fans to reupload it outside of Anycolor's reach.

Afterwards, she attempted suicide and was harassed by the company while convalescing in the hospital, to the point where hospital staff had to bar Niji employees from attempting to contact Selen until she was released. Nijisanji took this as failure to deal in a negotiation regarding the future of Selen's contract and unilaterally terminated it without forewarning. They then released a 3-page statement smearing Selen and unintentionally implicating themselves and their talents in wrongdoing they hadn't even been publicly accused of.
Selen expressed a desire to keep the conflict out of the public eye and resolve things through legitimate, court-sanctioned means.
Nijisanji continued to release frequent public statements smearing Selen and implicating themselves deeper and deeper into wrongdoings which they had not been publicly accused of, going as far as to use talents as mouthpieces to further criticize her and hijack their social media accounts to promote their hitpieces.

We're still at the point where NijiEN management denies wrongdoing for things they have accused themselves of and has shown no interest in reforming its management system, holding offending employees accountable or emphasizing the wellbeing of their talents.

Srs version

Mel:
> Well-known to be air-headed so an accidental slip is plausible
> Termination notice is short, sweet, and professional
> Given a chance at a farewell statement where she apologizes and admits her own mistake
> PL also apologizes, goes on hiatus which is understandable
> Channel content left up for a whole month for people to make their peace with it
> All talents at the company clearly very sad and mourning her loss
> Actual tweets from the CEO and upper management thanking her for her hard work and giving her well wishes
> Fairly solid trust in the company itself
Result: acceptable margin of error that Mel did indeed make a mistake and Cover's hand was forced, no real hard feelings

Selen:
> Well-known to work very hard and get things done, perhaps TOO well, with a history of management cancelling her projects on her
> Company itself has self-admitted to stealth suspensions and skinwalking their liver's socials, so the accident tweet was already under suspicion
> Other graduations/terminations in EN have been under suspicious conditions or reincarnations have alluded that things were Not Good behind the scenes
> After a month of radio silence, drops a novel-length termination notice to assassinate her character
> PL immediately speaks up and claims she will not be silenced, goes back to her activities immediately
> Entire channel and socials wiped before the announcement even went live
> Other livers either stick heads in sand and pretend nothing's wrong or post suspicious tweets and go radio silent, some still unheard from
> Releasing terrible PR disasters - first the two-sentence IR that called Selen "negligible" in English, then the stream that happened last night that was a whole shitshow in and of itself
Result: Everything official from the company is now completely untrustworthy and even if Selen made a mistake, the incompetence handling this situation will forever blacken its name, NijiEN reputation is ruined

So, the major difference here is in the quality of management.

In Mel's case, Cover and Mel respectfully parted ways after acknowledging a mistake was made. While it was a firing and not a graduation, no major bridges were burned, and there is no apparent animosity from either side. Any outrage was allowed to blow over, and business continues as usual.

Nijisanji, on the other hand... let us count the ways.
>Repeated instances of cancelling Selen's projects
>Banned her from planning any further cross-branch events
>Didn't know about the music video cover she was making, despite her getting permission from the song's creator a year in advance. If a manager doesn't know what their employee has been doing for a year, that's on management.
>Posts on Selen's twitter account days after suspending her, posing as her
>Writes an angry novel for her termination notice, trying to make her appear too toxic for any other company to want to hire. Posts the termination before even informing her.
>Refuses to let things blow over, and instead get three other talents to all line up for a video where they break legal confidentiality agreements. Clearly didn't get proper permissions for that shit!
>Posts a follow-up claiming that they investigated themselves about the NDA breach and found they did nothing wrong. Because handing confidential documents to people not under the agreement and letting them spread the information instead is apparently how they think the law works.

tl;dr: Cover is run by professionals that responded to their crisis professionally. Anycolor on the other hand is apparently run by clowns that think "passing the bar" is something you do when you realize you've already had to much to drink on a bar crawl.

If Anycolor handled it with any competence, there wouldn't really be much controversy. At worst, people would wonder what Niji was being so incredibly petty over but plenty of bootlickers and ruleniggers would side them them over this. There's also the fact that Selen tried to commit suicide and Nijisanji sockpuppeted her on her socials while she was in the hospital. Niji in their termination notice then implicated their own talents in bullying. Selen hadn't said anything, nobody knew anything, no names were mentioned and Dokibird was telling people to move on and not harass anyone, and nobody had anything to go by except Niji's own self-incrimination. They then make a public stream talking about the matter where they actually out themselves, name names and do so in a way that is publicly harassing Dokibird, who had just started her first real stream since leaving. Everything about the way Niji handled it was a catastrophe. If they said nothing at all things would have been mostly fine and left to speculation at most.

Mel made her own statement, admitted fault (you might assume she was lying/pressured or w/e but there's nothing to really support that) and seemed to have parted on good terms. Hololive said nothing and mentioned no details, Mel said her piece and moved on. The only way this would be remotely similar is if Hololive started going after Mel.

The funniest thing is that the thing that kicked it off was a melancholy MV about parting with people you care about. Niji axed it, threw dirt in her face, kicked her out and shit themselves in an effort to rub off the stench on her.

>> No.68952519

Mel was terminated for a mistake and hololive seems to have realized there is potential for the same mistake to be made by other talents, so they spent little time blaming Mel aside from acknowledging it was her mistake, then went on to talk to everyone and ensure no one else makes the same one. Hololive basically learned from Mel's mistake and tried to resolve any internal issues that might lead to the mistake happening again.

Selen making the mistake is disputed, and similar situations at Nijisanji have been disputed before. Even if Selen made the mistake, Nijisanji is focused more on the character assassination of Selen than trying to ensure rights issues such as Selen's cannot happen again. The very fact three talents were allowed to make a legally questionable statement is concerning and shows Nijisanji has learned nothing from the event, instead choosing to blame everything on Selen.

One of these learned and grew as the result of losing a talent to legal issues, the other is throwing a tantrum and sperging out just to try and deny any fault of their own.

A lot of anons in this thread seem to be confused.
Breaking NDA doesn't get you fired. This is something that various talents have done in the past with varying degrees of repercussion.
Breaking NDA combined with management wanting you gone is what gets you fired.
It ultimately comes down to the nature of the breach, and the surrounding circumstances.

A Hollywood movie production company isn't going to fire Tom Cruise for leaking some detail about a movie they didn't want him to talk about on a late night talk show, for example. Something to that effect literally happened with Tom Holland where he accidentally said something about an upcoming movie and nothing happened. Multiple games have been announced by celebrities accidentally leaking that they were working on a game for so and so company and didn't know that they weren't supposed to talk about it despite them being under NDA.
Nothing is ever written in stone and contract terminations are not automatic. If the Cover wanted to keep Mel around despite her NDA breach, they would have.

there's a small difference between firing an employee and firing the star of your movie and I guarantee you if it wasn't someone as important to the movie they fire the person. but yes, breaking NDA doesn't automatically fires you but it's grounds for doing so. usually it depends on what information was leaked

The problem was the total shitfit people had after Yugo and wanting transparency. So niji gave transparency with Zaion and it seemed to go over well. Third time was not the charm but this is a butterfly effect from people screaming about needing all the details. Now you get the details and that's the problem.

>> No.68966405

Not cleared by Nijisanji management to post it yet. if everything was fine all she had to do was wait a couple days. This is not the first or last time this has happened to any corporate vtuber, Selen was just the first one to ignore that and post it anyway

I don't get what's hard to understand about this. The company has to verify what you've got setup.

The problem with breaking NDA is in Japan the company doesn't usually have a choice in firing you or not. It's fucked up but if you don't fire someone for NDA breach you genuinely cannot defend NDA breaches in the future in court. This is why Japanese companies can be so litigious. Look at NIntendo.

>> No.68972937

Honestly? I think it had to do with something like interpersonal drama among the people at Cover. If it were something like Mel complaining to her friend about another holo getting special treatment because they're in a relationship with their manager or staff, then it would make perfect sense why some people want her fired for leaking it, while others don't care or might even be on her side.
But that is purely speculative and there is no proof anything like that is happening, but leaking interpersonal details would pretty much explain everything and I'm not sure what else it could be that Mel would have knowledge of as a talent and not a member of staff.
