I think they are going to claim that they thought the video included not only images of the model(which they indeed own) but also voices of them as the characters which do in fact require a permission from the graduated and didn't want to deal with that at the moment.

The OP is a Discord message Selen gave to the people who made her "Last Cup of Coffee" MV. It was put up back in December but many people called it a hoax. In the stream held today by Elira they showed off a screenshot of messages between Selen and Management leading up to them privating her cover.

In that screenshot it shows that Nijisanji does, in fact, stop current Nijisanji talents from depicting former Nijisanji talents without corporate approval. (A policy so dumb, it was what caused a lot of people to disregard the initial screeenshot as fake).
