Why would you work for Nijisanji if you had a choice? Theoretically if Riku and Yagoo both come calling is anyone out there really choosing Niji over Hololive? This whole time I had been under the assumption that Hololive rules were more strict than Niji because muh idol culture, but it sounds like not only are the rules more strict at Niji, but the punishments for breaking those rules are more severe.

Hololive doesn't actually need to enforce many rules, because the holobox works by being self-regulating. If you stray too far from what's expected of you, you fall out of the holobox. And the only way back in is to collab with your coworkers and get them to bail you out, like Towa or (to much more limited success) Mori. Just look at Laplus.
Cover doesn't need to make its talents avoid males or not mouth off about "smelly otaku". It's very Japanese in that sense, in that you're expected to understand it implicitly--because it's much more awkward to have to say it out loud compared to everyone just getting with the program.
HoloEN had to go through some rough patches before everyone got onboard, but now look at them--it's the same as JP. Most don't collab with males, some do (well, mostly just Bae).
Give your employees an incentive to follow the suggested guidelines, and you won't ever need to turn the suggestions into rules.
With how understaffed they are, they don't give a shit about most of the talents because they literally can't with so few managers. If the corpo doesn't give a shit about you, you don't give a shit about the corpo. So they have to rule through fear with an iron fist.
