Invaders 2 had different terms: they could keep using their old IP and retain the rights, or get new everything, paid for and owned by Phase. All chose the latter, for different reasons, and redebuted with new models and channels.
Invaders 3 are probably the same as 2, so you could see some high profile indies join with their own IP. In theory. The arrangements are still being made, and I don't know if there actually will be anyone like that.
