They might have given niji some odd exception, but a few years ago Nintendo successfully lobbied to effectively make console modding illegal in Japan. They got a bill passed that made it illegal to profit off modding, so you can't sell any hardware that could be used to mod or charge for it's installation. I assume nijis are using hardware that was modded before that bill was passed.

Nintendo probably let this slide because they stopped offering the official 3DS capture kits in 2020, so there'd be no way to stream/record the games if they kept the old rules in place. The official capture kits were also very annoying to deal with (Nintendo had to install them in your office, and they bolted them to the floor).
Incidentally Cover seem to have one of those official media units in their office. I think they got it from Square-Enix.
