I'm not a nijifag but for defamation cases, especially when it causes financial damage to the defendant, it doesn't matter if you're spouting the truth, you can absolutely still sue for damages. I'm not a great legal scholar though and it's not the same in every state/country. I think Niji (hopefully) has enough sense to know that if they did pursue legal action they'd be outright doxxing the guy and it would look terrible on their end and a lot of talents would drop them instantly if that happens.

Harder to do so outside Japan. In Japan this would be slam dunk, which is why victimized Idols who suffered actual abuse (as opposed to simple mismanagement and neglect) can hardly speak up at all.
In US, it is extremely hard to do so unless the suing victim is incredibly sympathetic (and this part is subjective to the whim of the judges, look at Sandy Hook families vs Alex Jones, compare this to Hulk Hogan vs Gawker)
Overall, suing is easy, winning a lawsuit is harder, and I don't think it is a matter of Niji being smart. It is a matter of them not being bothered/too lazy to take action.
