Wrong, derivative works are still under the copyright of their artist unless an agreement transferring the rights is made in a legally binding way. The holders of the original intellectual property may decide it's unauthorized and use legal means to stop distribution of it (lol) and possibly seek damages - but they don't have the right to do anything with the fanwork itself as it's not theirs.
