That's not how that whole art circle works. By even being able to release the game it was a big deal, but the fact that it got free publicity and marketing that would've normally cost hundreds of thousands of dollars is already a win. Now the devs got some recognition by Cover they might actually be hired to help with Holoearth, and even if they don't they can still put the game on their resume or if they start a kickstarter project they can reference HoloCure as their ability to actually make something. In that world releasing content comes first and monetizing comes second. I also wouldn't be surprised if they eventually set up some kind of donation or talk it over with Cover and have it released on Steam as a full version with updates like VS after they negotiate the profit split.

By the time Gen 3 get added, its probably another 6 months or so. People will just remember Rushia's incident as a sad incident. Even Cover do not go after her that much beyond privating/removing her own channel. All her Hologras, official musics, appearance, etc, all still up.

It's not shilling. It's a great fan game that gives good buffs due to this and also being better Vampire Survivors.
It didn't cost COVER any money to do (unless their shitty games in development).
It's also somehow evergreen content, viewers will keep coming for future updates just to see them react to new Holo references or to see their oshi finally being a character in game.
This last fact is probably the most important because they get desperate to have some FOTM to fill their usually pretty lacking/lazy stream schedules.
The game dev should be considered an hero for making free content to them.

There's no way Cover would be dumb enough to draw the contract like that. Seems far more likely to me that they own the full rights to the character of Rushia, but it would be seen as unethical/bad PR to continue profiting off the character after firing the person who played her and made her popular. But this is a free fan game that Cover is not profiting from, so it's probably okay for the dev to add Rushia if he wants to.
