I've been a Mel fan since near the start of her career. was around for when digi(the original modeler and riger) tried copyright claim Mel on Twitch. I took the time to look into copyright I have a bit over basic understanding and how things work but I'm not an expert. It's basically something that would be up in the air and I'll be up to the courts to decide. I would think with the idea of someone commissioning a model that looks like a Mouse depending on how closely it looks like Mouse the more it looks like her the harder it would be to claim it's an original character. as for vshojo making a character that resembles Mouse to keep selling merch after she left I'm pretty sure a judge would see right through it and rule in Mouse's favor, but doing something like that would be a massive hit to their reputation and it would not be worth it
