To avoid any DMCA issues Cover asks game developers/publishers for written permission before Holomems are allowed to stream any game. This also includes stuff like are they allowed to monetise the stream, have Super Chats on, or stream the game during Member's Only streams.

Some companies are quite lenient with it, like with Minecraft they can stream it whenever they want. Some companies are more strict, like with Elden Ring the streamer has to announce beforehands when are they going to play the game on stream and for how long. The Pokemon Company gave them blanket permissions to do whatever they want with the game but only for one month. After that they're not allowed to stream it anymore.

In principal, asking for permissions is a smart idea because you won't get fucked later on with copyright strikes but Cover takes it really far by being super careful with them. This limits what Holomems are allowed to stream by quite a lot. Something your average streamer on Twitch or YouTube does not need to care about. This is also partially why you see everyone from Hololive suddenly playing the same games when they get permissions for anything new.

I read on /ggg/ that Gura had asked management for permissions to a massive list of like dozens of games just to have the permissions ready in case she ever wanted to play any of the games but afaik nothing came out of that.

It's up to the copyright holder to pursue damages in the west as well. The entire business model of Twitch streamers is in a legal grey area because game developers and publishers simply don't want to DMCA content creators. Playing through a video game on stream is not generally considered transformative content so if it ever came to that, pretty much everyone streaming video games would get hit with copyright strikes. Only recently have game developers started to include streaming permissions into their terms of service because it's great advertisement for them.
