It seems like as Cover gets permissions back more and more the privated archives will be re-released (like Subaru re-uploading her undertale playthrough). I don't know for sure, but also have a feeling most of the deleted ones are stored on some /t/ user's hard drive. So like, why make such a big deal about it? Isn't the worst of it behind us?

Essentially what happened is that they lost almost all permissions. Why? Because Cover thought the same permissions deal they had for a single streamer would work for multiple streamers. Well, it didn't, and all was lost. However, almost all of the lost videos are archived and easily findable. It was terrible, original songs, and stuff that Cover had copyright was removed as well. Subarus manager deleted some of the videos instead of privating them.

That video was made just when the great purge occured. Mio was streaming an emulated Capcom game which got Mio her first strike. As Cover had no prior experience handling this, they privated/deleted +90% of all their videos.

The damage done was heavy. Most channels still have over 50% of the privatised videos still missing. Archive anon is nice but that still doesn't help how Hololive's growth was hampered a bit by the mass loss in views. Plus this probably scared cover into stopping the more risque streams. That is why there are no more 3D Swimsuit models and the more sexual ASMR content that Choco and Mel did are missing aswell. Something those two never really recovered from, especially since Mel had a 3 month long hiatus do to handling the sexual harrassment situation.

No, it's the same in the US. Streaming someone else's game without a license to do so is copyright infringment and the copyright holder CAN sue you or send takedown requests or whatever. It's exactly the same as playing music or watching an anime on stream that you don't have a license for. You just have to hope that the owner never takes any action against you. Most of the time for video games the owner does nothing, but you have zero legal protection from them sending you a lawsuit or them sending takedown requests.

the last of us 2 situation was extremely fucked, sony was DMCA'ing videos that featured no leaked footage from the game whatsoever. they couldn't even argue what they were doing was legal which is why they settled with creators and started restoring videos a few days after that shit went down before it could develop into a court case.
