Well my issue with what you're saying is that you're not speaking in legal, you're speaking in retard. Idealistic retard at that. Vtubers are probably considered as voice actors because I doubt Japan has passed specific legislation for Vtubers (and also they don't operate under common law).
...Though that also doesn't really mean much, I guess. If the industry standards are for chuubas and people playing any such characters to get a cut then they'd probably demand as much in their contracts, and if the Holomems have said they get a cut then I've no reason to doubt it.
