Battle Network's fan community has so many things that would be a higher priority for Capcom to C&D, like actual full fangames using the BN characters. There's at least 3 "Battle Network 7" style continuations off the top of my head (at least one of which is still in active development) that they would C&D first.
Even in non-fangames you have stuff like One Step From Eden and EndCycle VS that have been around for years without getting any attention.
Raw game mechanics are not subject to copyright enforcement anywhere that it matters. You can't claim that all 3x6 grids are your idea.
