We've had a discussion about this before regarding another vtuber. Essentially, unless Zaion is living in Japan, she can join another agency and Nijisanji wouldn't be able to do anything about it (unless they bother suing her in her country, where her country's own laws on non-competes would apply).
Actually, even in Japan itself, enforcing a non-compete is not so clear cut, since the Japanese Constitution has a provision where people are allowed to switch jobs "to the extent that it does not interfere with the public welfare."

Depends on the country you're in. In my country, you still have to comply with the non-compete even if you got terminated.
