Mario doesn't even remotely fuck around, as Wario learned. I think Wario must also have come to the conclusion that he can avoid Mario's wrath by robbing outlaws who themselves have robbed Mario, his associates, or the Mushroom Kingdom. Now, Syrup would rob Wario back, but with enough effort and tenacity he could regain his fabulous castle and double-ill-gotten wealth, gathering further wealth along the way.

I guess think of it a bit like in the age of sail, and the difference between a regular old seafaring crew of pirates, and a crew of privateers with a letter of mark from their government, giving them the legal license to raid and plunder vessels belonging to an enemy state. I want to imagine that Wario is some sort of one-man privateer sanctioned by Princess Peach, perhaps she envisioned that he would engage Koopa vessels, but that didn't seem to happen, maybe they are too militarized and organized for it to be worth the hassle for him.
