What and get DMCA'd? You can't get in legal trouble for distributing patches but you can get in trouble for making and distributing fan games.

Also lack of console compatibility is sadly very common with Mario 64 hacks. The hacking scene has always worked with emulators in mind rather than real hardware, it's only very recently that there's been any effort to make SM64 hacks work on real N64.
