2). Rod Serling didn't own Twilight Zone; He sold it to CBS because he thought that it wouldn't make any money after the series ended.
3). Nintendo is a big company and, despite CBS being a big company, by that time, it probably wouldn't have been worth the effort. Nintendo could have easily argued coincidence and that the two products wouldn't have been confused for one another.
