If a game is still available to purchase from a publisher but the developer is now defunct, I consider piracy.

If a game is available to purchase from a publisher but is only made available in a gimped form like very poor port or emulation (that is often worse than using a free emulator, l'm looking at you Sony and Nintendo) I will likely pirate.

If a game is no longer available to purchase from the publisher at all, I have zero qualms with piracy.

These. If you look at piracy of decades-old software in a black and white fashion, you're a corporate cuck. If a legitimate effort is made to put something out with love I'll happily buy it, it just seldom is these days. Companies are making less effort than ever, the Playstation Classic is a complete joke even the most diehard fans are turning their nose up at.

the only games I play pirated are games I've already played and paid for (sometimes multiple times in the case of a game like Final Fantasy IV which has had multiple remakes)
and for me emulating is a superior experience in most respects. If I could buy DRM-free digital copies of roms I would.

I don't pirate games from gog.com.

They're too old for any reasonable person to think copyright should be applied to them. The NES is 33 years old now. The original copyright law was 14 years and an extension of 14 if the author was alive after the first 14 years expired, A max of 28 years.
Many if the devs who made those games are now defunct, shut down, and no longer make any profit from their games.
Used games are equivalent to piracy, except you most likely overpay, for a locked down and inferior product. Nintendo doesn't make any money from you buying your 9th copy of SMB/Duh Cunt, so why give some schmuck your hard earned dineros when you could just pirate it in the first place?
Piracy is the only true preservation method. Collector's will die out and their earthly goods will either be destroyed, or sold at a huge markup price. Piracy via torrents makes sure the content is preserved for generations. And if everyone has a copy, then it can never truly be lost.
