I wasn't referring to legal status, I was referring to how easy/hard they are to emulate. I expect Nintendo to take the easy way out and skip any games that would require additional code/better hardware. There are no SFX or SA-1 games on the 3DS. (DSP games are pretty easy to emulate)

Even the retroarch emulators for Wii have trouble playing Kirby 3 at full speed.

Note how the NES mini conspicuously skips Castlevania 3, which generally gives emulators a hard time.

They certainly wouldn't have a hard time finding 30 non-chip games to play, depending on licensing, so I expect them to go that route.

Huh, looks like Kirby 3 got a VC release on Wii. Nint is pretty strict about emulator quality, so I guess I'll have to get a wad manager going.

The point remains that I expect them to try to get away with as cheap of hardware as they can get away with, which probably means going with vanilla games. $60 is a good, normie friendly price point and I don't expect they'll be able to go much higher than this unless they include a proper cartridge slot.

This is assuming they ever actually release a SNES mini in the first place.

My point is there is no incentive to create anything new. If you have a product that you can resell to the same idiots year after year, that is a much less risky endeavor. Personally I like creativity, and not every idea has to be shoe-horned into existing franchises. I'd rather have a great game with no sequels, than a game franchise that beats the horse to death.

The only modern games I've been able to stand in recent years have been from independent companies because they have to have fresh ideas to survive.
