I forget exactly where I read this, but despite Nintendo owning the characters, the way the contract was drawn up between both companies means that all of the code and assets for their games was Rare's - now Microsoft's - property. This is why they can, for example, commission ports of Banjo and Conker based on the original N64 code. Nintendo has no claim to the characters and they can therefore do whatever they want with the code and assets.

It'd be safe to assume that Microsoft is smart enough to attempt to barter Nintendo into submission for the right to actually sell the games they funded years ago. Shame, really, because all it does is make people further resent Microsoft for purchasing Rare in the first place and further sully the brand name they push out once every couple of years on some outsourced game they needed a recognisable name on.

>>1587256
Insight into reseller logic here (from somebody who is, thankfully, not one of those pieces of shit) - If they donate those games to charity or offload them at a loss, somebody else could take their "investment" and get the expected returns (not that they ever would); so rather than risk that happening, we have to burn that shit to the ground. It's like that kid. You know that kid. He invites you over to play Street Fighter 2 and you fucking school him, so he kicks you out of his house. If they can't have the glory, the returns, nobody else can.

I expect this to culminate in a lot of rare prototypes being lost to the ages.
