I'm pretty sure no one can *legally* do anything productive or serious with leaked code. The only reason the SM64 PC port was legally possible was because the SM64 source code they used was decompiled from the ROM rather than from a Nintendo leak. Afaik, no proprietary information or documentation was used for the project (this is called clean-room reverse engineering).

They lost the original 3D model assets, not the source code. The entire game is built in the same engine and you can switch between original and new graphics. They had to make new 3D models for the graphics and sometimes had to make guesses based on artwork and what they can make out of the sprite.
