This is extremely debatable. If I don't buy/own a copy of a game (or even an arcade pcb) that I wanted to play, I would just go ahead and download it off the web and play it on an emulator, which is considered illegal, due to piracy. I've been aware, paranoid, confused, and even frustrated over this, since earlier this year. So I've decided to use my VPN.

I've been downloading roms since 98 and haven't had any problems except that one time I seeded a PSX RE game, at which point I never seeded again and have been fine since. Direct downloads are always safe and if you torrent, just never seed and you should be fine.

You will never ever EVER get a complaint for PURELY downloading a ROM. It is only in the case of utilizing peer to peer systems where you can risk getting a notice sent to your ISP - This is ONLY because you are actively sharing and uploading the data with peers during the download. HTTP, HTTPS, FTP, all fine because you're not the one distributing the data.

most emulators come from linux so if you are paranoid then change your OS.
most emulator developers just put the blame on the end user for the usage they don't give a damn about piracy and has always been like that.

this is why we need to get all these street-roms off the web. people think they can just download whatever they want and end up holding the bag when it comes time to pay the piper, because Nintendo won't give you a refund for the roms you bought and you're not even allowed to keep them.
