The code itself should be fairly lightweight, it was written in the 90's so it should run on a lot of weaker systems. However the implementation and use of renderers to make porting easier is what will screw things up. There's zero, zilch, nada reason to write optimized code anymore, people have consoles strong enough to run any game and PC versions have settings to adjust.

They don't have to argue anything about losing money, the entire game is copyright from start to finish. The Mario image, Mario voice, Mushroom kingdom, Mario's distinct movement might even be copyrightable.

Playstation couldn't handle anything like Super Mario 64, PS2 more like. Even then, the N64 is a very unique system using all kinds of techniques like hardware compression, instantaneous cartridge-streaming and so on. If you're writing a game for multiple systems from scratch it one thing, trying to pull apart all the clever hacks and manipulations they had for the N64 is quite another. I'm very skeptical they will ever port it to PC, "working on a PC port of Mario 64"... we could all do that for the next five minutes, doesn't mean it'll ever happen.

It is legal to reverse engineer. Distribution or advertisement in any form (including footage on YouTube), however, is copyright infringement. The code is owned by Nintendo. Mario is owned by Nintendo. Nintendo has not given anyone the right to distribute Super Mario 64 or use Mario's name or image. Under U.S. law, this is plainly illegal. What I was talking about, which is a gray area, is that this brings us one step closer to a clean room designed re-implementation of Super Mario 64, which would not use the name Super Mario 64 or images from Super Mario 64 anywhere in its distribution, and does not contain game assets from Super Mario 64. A great example of exactly what I'm talking about is URDE: "re-implementation for games by Retro Studios." Nowhere does it say Metroid. Another example is OpenXCOM which does use the XCOM name and images in its advertising, which is probably not good, but they have not been pursued by Firaxis.
