But when you torrent, you are downloading AND uploading, so if they catch your IP connecting to 100 peers and uploading content you're suddenly on the hook for distribution.

I downloaded 190 gb of roms and isos over the last month on my cellphone, and my carrier was just mad about the volume of data. I paid up for another prepaid card, and they let me continue downloading shit.

Here's the thing: rom sites provide the roms in question. But they still exist.
Thousands of people visit any random rom site every day and download tons more shit than you do, and they're still out there doing it.
Nintendo themselves used downloaded roms for both of their classic consoles.
99% of roms out there are for games not even available for purchase on the market. Meaning your downloading of said roms harms no company at all. Especially roms from defunct companies.
Any of the abkve could easily be used in a sefense case.
The FBI doesn't have the resources to monitor, investigate or especially prosecute every individual who commits a cyber crime. They'd have to go after a quarter billion people, easily. They literally only go after the absolute worst offenders (who are not pirates, btw)
I know of people being caught by the government with literally thousands of pirated DVDs in their posession, and they gave zero fucks.

The only reasons they'd go after someone for piracy are:

>you use ad revenue from your rom site to trade in drugs, human trafficking or support terrorists (like any of that would happen)
I can't even fathom any other scenario where the feds woul come for you.

Worst thing that happens to most rom sites is cease and desist orders from Nintendo lawyers. No feds. And this never happens to people who download shit.

There are companies that the movies and recording industry pays to enforce copyright claims. They collect IPs from a torrent, then submit the IPs to the ISP for them to deal with. IIRC comcast has a 6 strike policy where the first 3 or so are just warnings, and I don't think anyone has ever made it to level 6.
