Sonic is a proud anti-fascist and anarcho communist who understands that the police are simply an instrument of class rule. Even if Robotnik was taken in for questioning - say on suspicion of violating FAA regulations by flying too low when there was a risk of damage to persons or (more importantly) property, his position as a member of the bourgeoisie almost certifies that he'd have lawyers sufficient to argue himself out of the charges - or possibly even have the legal training to argue his own way out, along with the full sympathy of the court system. Meanwhile, someone would ask Sonic why he's being going around smashing up computer monitors and stealing jewellery so he'd be taken straight off for a bit of the ol' police brutality and spurious charges.

Sonic proudly wears the colours of the Cuban flag, not the US flag. You can tell by the ratio of Red:Blue involved in his design. Blue is the least used colour in the US flag and most used in the Cuban flag, as well as the most used in Sonic's design. (Regardless of whether we include his arms.) Red is the joint-most prominent colour in the US flag, not blue. Meanwhile Robotnik's egg-mobile uses a paintscheme closest to that of the US Navy.

Furthermore let's not forget that Robotnik is based in part on US president and noted imperialist Theodore Roosevelt.
