How was this allowed? Why weren't there lawsuits issued out the ass by Capcom? If you took Mario, gave him a new name, and put him in your own game Nintendo would be all over your ass like bears on honey.

Different style, different proportions, different level of detail, different hair, etc. Yeah, they certainly look similar no doubt about it, but as long as they didn't literally swipe the sprite, this falls more under "direct inspiration" than under "total ripoff." Plus, as has been alluded to already, I would bet that most characters in SF were inspired by if not directly referenced from either manga characters or real people (see: JP M. Bison/US Balrog, and later Fei Long).

A brazilian movie starred by an ex-pornstar and former prostitute turned entertainer called Xuxa shameless ripped Blanka design for a character called "Curupira". Capcom didn't sue, possibly because Xuxa has connections to Mossad and organized crime.

The movie is "Xuxa E O Tesouro Da Cidade Perdida".

Xuxa did softcore porn before being an entertainer.

About lawsuits, in the Data East one, there were more grounds to sue for being a straight clone, since there were too many similarities:
- Yungmie's legs are ripped, like Chun-li's;
- Yungmie's walking backwards animation is the same as Ryu's
- Ray's stance and walking animation are the same as Ken's
- Jean was a Guile ripoff, through and through

The biggest offender is Yungmie, anyway. Karnov was already an established character way before this game, and Mizoguchi was a shotoclone that only copied the command inputs. Everything else was different.

Street Fighter II had a lot of character designers. The thing with SF characters is that a few of them are based on manga or real-world characters, so they're already "copies" to an extent. However, what Fighter's History did was copy SF, not the characters that SF copied from.

Curupira isn't green, Curupira doesn't have any electric powers, Curupira isn't called Jimmy, Curupira is not even a freaking human, but some kind of spirit elemental.

Blanka was inspired by Tarzan. Originally Blanka was just a "wild man", but they turned him green to make him more exotic.

Anyone who actually played both SMB and GGS will realize the two games actually play very differently. As a fan of both games I must admit that SMB is just the better game, strictly due to the super tight control.
But Mario can suck Giana's cock when it comes to music. The only reason the mario theme is so popular is because the game is so good.

That being said it was fucking stupid to make the first level of GGS look so much like SMB's 1-1. Also literally baiting Nintendo by writing "The brothers are dead" on the box cover.

But the came from the world of C64 where stealing, ripping and even using copyrighted music was okay.

Copyright wasn't that big of a deal in the pre-Napster era. Videogames were stealing from eachother left and right, but no one really cared. The Doom soundtrack contains tons of riffs that are blatantly stolen from famous rock/heavy metal songs. Also hip hop music in the 90s used tons of famous samples without anyone being sued either which is amazing considering how blatant that was as well. Having lived with DMCA for this long it's hard to to imagine anything else. Oh well, RIP early 90s

When I use the word "stealing" in regard to the C64 scene, I mean it quite literally. Sprites and animations were stolen and used unmodified in other games. Music were used from other games. And known musicians would find their music converted to chip tunes. Jean Michel Jarre in particular had his music used unlicensed a lot.

Don't get me wrong. I don't mind. It was a different time. But that shit wouldn't fly today.

Ironically enough I don't think Nintendo could have stopped Giana, had both games been made today. The similarities are either superficial or inherent to the platform genre.

They've launched some program where money-earning letsplayers will need to publish their crap through them and then Nintendo will pay them whatever it wishes ("up to 70% of ad revenue"). If you don't participate, they'll sue for selling Mario videos and win. Obviously, that's nothing compared to 100% all day everyday the letsplayers had had.

I have two comments on this.
1. Nintendo owns Mario and has the right to prevent people from earning money on game footage. They don't need the publicity, it's understandable if they want to monetize footage of their games. Unlike banning it and suing everybody, this is good capitalistic practice.
2. Fuck commercial youtubers. Fuck them with a fucking rake.

CHARIOTTT

>> No.2212519

>>2211910
That was because of tariffs raising the price of directly buying nintendo products so high that nobody was going to do it anyway, so it was more economical to pull out. From what I hear BRs mostly go secondhand or import anyway.

It was allowed because they were different games so they could have a blond white guy in each as long as the diversity quotas were met with other characters.

>> No.2212534

WRONG. Capcom actually sued data east because fighters history was a blatant rip off of street fighter (from the lifebars to the character selection screen). But capcom lost the dispute.

"tariffs".
Stop being retarded, bro. The ps4 and the xbawx1 are also being sold by ridiculously high prices in brazil and they still are doing "ok".
The whole bullshit of blaming it on the taxes is just to hide the fact that the wii u is a fucking blunder.

It is no surprise. Capcom in the 80s and early 90s loved to insert music references at any game specially from rock bands. Guy from final fight was "inspired" by fugazi singer Guy piccioto.

Sounds like someone is jelly :^)

How is LP not a real job if they can make a living?
Is being a musician or comedian not real jobs either?

No, fuck YOU. If you don't like LP, don't watch them. But supporting corporations' suppression of the users is stupid and in the end hurting everyone.
Nintendo doesn't loose anything by people making videos. They are not earning money that Nintendo would other wise have earned. In fact LPs are creating more interest in the games. But now a lot of normal people loose a way of income. Bravo Nintendo... Bravo!

>> No.2212791

Even though I hate letsplayers and all the shit related to them, I gotta agree with you. What nintendo is doing is dictatorial, invasive, stupid and overall greedy.
Just thinking about people forbiding someone broadcasting a game being played is akin to an amateur football player having to pay royalties to FIFA if he wants to upload a football match he played with his friends and recorded.

The button layout probably had something to do with to do with it. The 6 button layout was a Street Fighter-exclusive thing at that point, and went beyond the standard JAMMA hardware specifications. Which means they could have been infringing on hardware patents and such. It's telling that the sequel to Fighter's History switched to the Neo-Geo hardware and adopted its 4 button layout.

eh, at least Fighter's History and Karnov's Revenge are still pretty fun
They're unreasonably imitative of SF (Karnov's Revenge a decent bit less than OG Fighter's History), but they're okay (it's amazing how much bullshit Revenge has though -- WHEEL KICK and BALLOON are so fucking dumb, who thought full-duration invincible moves was a good idea).
