Check part IV. 3DRealms, and therefore Interceptor who acquired 3DRealms, still had the rights to in development game "Duke Nukem Survivor" which is the one you're reffering to, as well as any port of DN3D.

AFAIK Gearbox pretty much threatened them by playing on words and contract loopholes.

AFAIK, after the legal threats I just mentioned, Gearbox acquired all of Duke Nukem franchise (contrary to only a part of it).
That's why Megaton went down, the rights shifted to Gearbox.

If Gearbox was smart, they'd just re-make a similar contract with Devolver for Megaton, I mean the port is done, ready to be sold, but I'm not sure that's what's going to happen since they seem to be demanding way too much and they probably want to get 100% of the profit for themselves.
I don't know if it's true but I heard they were asking a lot of money to Devolver for Megaton sales.
