>woman convicted of raping boy
>woman gets pregnant
>years later woman sues for child support and wins.

this is legal, but is it ethical?

>> No.3821612

This is a lie, right?

I understand how it may have happened. The child needs financial support. But rip it from this terrible womans arms and give it to another family.

But yeah, I agree: that is pretty f-ed up. I feel bad for the child TBH.

Seriously what exactly is ethics?
Is it morals, a creed, or a code of some sort.
Are ethics elastic, or are they inelastic?

Laws don't necessarily have to be ethical btw.
Genocide isn't ethical, but it has been law.

>Victims have rights. Here, the victim also has responsibilities.

>A 34-year-old woman seduces a 15-year-old boy and becomes pregnant. She gives birth to a daughter and thereafter applies for Aid to Families with Dependent Children. Is the child's father obligated to pay child support even though he is a victim of statutory rape? (Pen. Code, ? 261.5, subd. (d).) We conclude he is liable for child support.

Source:
http://www.lawlink.com/research/caselevel3/74059

There is plenty of other case law which establishes this. These opinions are binding for statutory rape, and would appear to be binding for rape that involves sexual assault.

States have ruled that child support isn't a punishment, so a victim can't get out of child support.

>> No.3822092

>>3822048
Oh, and this is the kind of reasoning you typically find in these opinions:
1) Someone has to pay the mother child support.
2) The father (victim) is the only someone around.
3) Hence, the father ought to pay child support.

(2) is a false premise. Tax payers are someones.

Obviously victims of sex crimes are not considered to be a protected class by state governments. This is the deprivation of property under blatantly unfair conditions. It is mystifying that state supreme courts have not voided the relevant sections of child support law because of 14th Amendment violations and asked the legislature to fix them.

If the guy really didn't want sex he wouldn't have ejaculated and his penis would have been too soft to penetrate the vag.

>> No.3822136

As a rape victim and a minor, I don't think we can hold it against him.

Women decide whether or not to have children. Men don't have any option. 'Child support' is bullshit and our society needs to ditch it.

>> No.3822213

>>3822136

I don't think child support is bullshit, but it is done in a dumb way.

Assuming the woman has free access to abortion services, she should call the court after finding out she is pregnant, get them to track down the guy, inform him that he can either choose parental rights or not. If he does not chose parental rights, he merely owes either abortion fees or just one year of child support. Tough luck if there are too many guys for the woman to track down the father.

But you can't have it both ways.
If the "he knew what he was doing" argument gets him into child support, it should also have gotten HER out of rape charges.
Instead they rule that she forced it on him, and make him have to pay a rape tax.

It's statutory rape.

She had sex with someone who is underage. Which is considered statutory rape.

It doesn't matter if he liked it or didn't like it. That isn't even a consideration. She had sex with an underage boy, it is therefore statutory rape.

>> No.3826097 [DELETED]

>>3822048

>>statutory rape

So basically there was no rape at all. The psycho-social aspects of this are identical to an adult man getting a woman pregnant and then refusing to pay for the child.

All you misogynists can take it easy now.

Child support is legalized extortion. If some stupid bitch cant afford children then she should NOT HAVE CHILDREN.

just because he enjoyed it does not mean he was of legal age. this means, under the law, that he might not fully understand the consequences of his actions. at 15, you might have gone along with it too. at 18-19, you should know better, and if she gets pregnant, you should have thought about that. I'd say that at 15 he likely hadn't appreciated the consequences of his actions, making it... STATUTORY RAPE. Especially if she turns around in 3 years and demands child support. That shit's just fucked up. I'd probably move to a different state and stop paying... or keep appealing that shit until a competent judge is found.
