The default state is rejection by FDA. Thats why the company has been in development for the last 6 years+. The only thing that matters is that they're developing/perfecting their methods until approval.

The issue isn't making a great tool, its making a consumer product that works well at scale. It's really not the same thing, and I don't think Musk ever claimed to have been the first to develop BCI's. This has been Musk's MO with essentially everything he's put his weight behind. There are a lot of very talented people that can make fantastic prototypes, but you have to ask why with the existing and available technology we still haven't seen commercial use of most of these tools? You could say the same about propulsive rocketry.
