It's actually not. Most institutions have a policy whereby students enrolled can audit classes they are not enrolled in. Where audit means to attend classes but not receive credit and not able to have tests and assignments graded. If you are not enrolled in the institution and attending classes you are universally considered a trespasser.

You can. If you aren't causing a disruption they have no reason to ask you any questions and will just leave you alone. The question about the legality of sitting in on a lecture at an institution where you are not actually a student is clear however. Per the letter of the law it is illegal but for practical purposes it's unenforceable.
