here's where you're confused. It goes more like this

Static electric and magnetic fields exist independently of each other. Only when you introduce time dependence you get EM waves.

The idea that a scalar potential with a wave equation exists in a field where E= B = Curl A = 0 shows something is quite interesting in regards to the 'elasticity' of space
