You can there is a loophole: space mining.

Nations own stuff they put into space and are liable for damages caused by said things. And nations are free to use space resources however they like. If you mine resources, they become part of the space thing and you own it, much in the same way fishing companies own fish they catch.

Why should any earthly nation give a shit about Martian politics and launch missiles that travel for months only to destroy some fuckers you'll never meet? A colony will never be more than a huge prestige project; prestige that won't disappear even in the event of formal secession. Colonies in space beyond Earth's orbit won't have economic value in the foreseeable future. Maybe when a big interstellar mission is launched, but we're far away from that point.
