I have no idea if black students are more likely to get caught cheating in this course–my guess is no. But if this was the case, I don't see how it would suggest bias. Needing to copy previous assignments is a result of poor preparation / aptitude for the subject. One would think this would correlate with standardized test scores, and obviously there is a racial component to this.

This is why AA, and really any kind of non-academic based admission (athletes, legacy, etc.), bothers me. These schools admit a huge number of students who will never be able succeed academically in most fields.
