John Wayne is probably dead by the year of Glad considering how Hal speaks of him. However he was not an agent of the AFR, he was an agent for the FLQ. He worked with Hal and Gately to prevent the AFR from obtaining the master because of political fallout between the two factions.

most blogs/analysis/reviews seem to think based on the way Hal spoke of Wayne in the 'beginning' of the story that he had been killed. But what happened to him is almost unquestionable; he was crippled by the AFR.
-he has a relative in the AFR who was the only person to not even attempt to move out of the way of the crippling train.
-foreshadowing his loss of legs with his dressing up as a PUNTER during his relation with Avril
-most importantly, look very closely at DFW's choice of words when Hal is remembering his search for 'Himself's' skull. Hal invisions John Wayne STANDING guard. Not watching guard or keeping watch. This seems poignant considering the lack of clues revealed through direct storytelling and that the reminiscence occurs in the last few paragraphs of the book. A great many people seem to have missed this

I think you're reaching a bit here. His dressing up as a punter has way more to do with the implied sexual relationship b/t Avril and Orin than it does John Wayne's loss of legs. Also, the last point just seems to pick and choose. Standing guard is a pretty normal way of describing that, unlike "watching guard." Plus, why would they just cripple him? Are they going to make him an AFR member even though he's allied with the FLQ? If you're an enemy of the AFR, you're probably getting a spike through the eye.

Dressing as a punter is definitely about Avril/Orin, and the bit about him standing guard is definitely reaching.
