The justice system is based on an unjustified a priori assumption of free will and moral culpability, natural for an institutional that is an accumulation of several centuries of reform and debate. If we are wrong on this basic assumption, then our entire judiciary turns into nothing more a cruel and inhumane game, a spectacle, with no real relation to "justice" in any meaningful sense of the word at all. This is a pressing moral question which ought to be investigated with rigour and pathos rather than waved off as irrelevant or speculative.

Interesting reaction, why are you so incensed? Notice how I didn't even say that free will doesn't exist, but that our assumption is entirely uncertain, and that its only if our assumption is wrong that justice is compromised. Remember that my point is that the very fact that our moral assumption is unjustified means we shouldn't wave this off as speculation, but that if we are truly concerned with morality and justice, we should investigate the possibility. Your angry replies refuse to entertain the idea. What is the bad faith supposed to demonstrate?

As for the last poster, I admire Aquinas and Thomistic philosophy and grew up in a secular family and started going to church of my own volitiion when I became an adult. And as far as I know, Sam Harris just says something like "free will doesn't exist but we should act like it does anyway", which is far removed from anything I'm discussing in both the grandiosity of its claims and the moral integrity I'm perhaps stubbornly trying to preserve. Try Galen Strawson instead.
