sanders and warrens wealth tax is unconstitutional

if they get elected it will have to go to the supreme court; out of the 9 supreme court justices 5 of them tend to lean right politically and 4 lean left. A wealth tax would get shut down.

The only chance is if one of them dies and a left leaning replacement is appointed by Sanders/Warren but the only two that are old enough where that is realistically a possibility are Ginsberg and Breyer who both lean left already

Please keep in mind I am not commenting in support or against a wealth tax. I am merely stating facts

I am not saying taxes are unconstitutional. To be completely fair I should not have used the word unconstitutional; the reality is there has never been a wealth tax in the US (no, estate tax does not count) so the question of constitutionality has never been answered, but case law errs on the side of unconstitutional so most agree that a wealth tax would require a constitutional amendment or overturning case law.

The above is said in reference to a general concept of a "wealth tax"; in this case specifically, the two different wealth taxes suggested by Sanders and Warren were worked on extensively by economists Emmanuel Saez and Gabriel Zucman. Sanders' wealth tax in particular was basically orchestrated by Saez/Zucman. And Saez himself admits that his proposed wealth tax would have to go to the Supreme Court in order to be enacted.

So we have already an existing question of constitutionality regarding wealth taxes in general, as well as the creator of Sanders/Warren's wealth tax bluntly saying himself that it will be up to the Supreme Court to decide.

when I say lean one way or another politically I don't mean explicitly. I mean they have a record of ruling one way or another on very contentious, hot button issues like abortion, same sex marriage, gun laws etc. in this case a wealth tax.

It is not like the current House or Senate, where they will all vote along party lines just because (see impeachment debacle). These are all very respected professionals at the top of their field whose first and foremost concern when ruling on any issue will be the United States Constitution. Of course the constitution itself is open to interpretation so that is why we don't always have every justice agree, and in some cases, i.e. very contentious issues like same sex marriage, the supreme court is split 5-4.

no problem. I should add that judges don't always vote the way you'd "expect" them to based on their record. Some like Ginsberg or Thomas you can be pretty confident will rule more liberal or conservative respectively, whereas some are considered more "center" because they may flip-flop for a lack of a better term. Roberts is probably the only sitting justice you could say this about but even he tends to have a bit of a conservative bias

Somehow they do in civilized Nordic countries. And while they evade a lot in mainland Yurope, they still pay more than in Burgerland too.

The loopholes they use can be closed in a day, and even most criminals know better than to fuck with IRS. (and hiring more people to do audits would please the muh jobs crowd too) Besides going for rich tax evaders is generally the simplest way to fix the budget after cutting military spending.
