bataille's notion of the "acephalic" body politic is a direct response to the "crisis of constitutionalism" of the early 20th century, and is in direct contrast to schmitt's democratic-dictator model. bataille is essentially taking the hobbesian concept and splicing it into an early 20th century philosophical rejection of "god" and "godheads" and the ensuing turn to nature, the self, the "informe", etc. as sources of normative and epistemological order. it's basically bataille's attempt to infuse a constitutional order with the utopian non-order likings of something like de Sade's libertinism and mallarme's non-structural artform.
