China Launches “One Thousand” Ships to Protect Disputed Islands

>Things between Japan and China are heating up over a territorial spat. One thousand Chinese fishing vessels set sail and will land in the disputed islands known as "Senkaku" in Japanese and Diaoyu in China.

Though the East China Sea is becoming heavily populated with Chinese trawlers with the start this week of a fishing season, Japanese officials reported that as of Tuesday evening a giant flotilla hadn't materialized near the islands, known as Senkaku in Japan and Diaoyu in China. The Japanese Coast Guard did report sighting 11 Chinese patrol boats Tuesday in areas adjacent to the Japanese territorial waters surrounding the islands, with three of them later entering the waters temporarily. Six Chinese patrol ships had sailed through those waters Friday, drawing loud protest from officials in Tokyo.

the real problem is that no Chinese representatives were present for the signing of the San Francisco Treaty where the USA returned/allowed to keep the islands Japan took from China. Same thing happened at the end of WW1.
The recent issue, which was pretty much resolved in 2008 when China and Japan agreed to shared the resources near (read:a fair distance from) the disputed island, was that Japan brought the island from its previous Japanese "owner" to claim it for itself.

to clarify, by "the treaties", I was referring to the treaty signed at the end of WW1 for the losers of the war to return territories conquered (where Japan was giving Germany's lands in China) and the San Francisco treaty between USA and Japan where US returned the occupied territories including the disputed islands.

Sovereignty over a territory requires that you be able to adequately defend it. Just because something was taken from you and that nation was defeated later on by someone else doesn't entitle you to get your stuff back. Legally, this is probably why China doesn't want to go to the courts - it's just a case of butthurt sovereignty fail. Of course diplomatic wrangling may give it a much more favourable outcome given its growing influence. No one wants another world war. So give them back the Rhineland. Czechoslovakia too? Fine. Fuck we all know where that leads. Quite the tricky situation. Can't just appease them but can't afford to seriously piss them off either.

Being fishing ships, they are civilians, thus, it is not a military matter. However, considering the large number of vessels, this will be difficult for Japanese coast guard to deal with them.
