ZUN wrote up a pretty liberal license allowing fans to use his characters and settings in derivative works:

Trademark is a separate issue. ZUN never filed for the relevant trademarks, so some turbonerd beat him to it. Not sure what ever came of that, but my guess is it'll either be declared void somehow, or ZUN will have to pay an out-of-court settlement (that's how these things usually end).
