The dude was charged for obscenity, which can be and is applied to the whole spectrum of pornography in the rare instance that somebody somewhere is butthurt about some picture of something. The Supreme Court has ruled in quite explicit language that lolicon is protected under the First Amendment. It's just that content deemed obscene enjoys no such status. To say that lolicon is illegal because one man was charged with obscenity for it would be to say that consensual heterosexual pornography depicting two adults is illegal as well, since the same charges have been filed in rare instances. More to the point: he pleaded guilty without deliberating the matter in court, so it's not even like there is a judicial precedent here that would suggest lolicon should be deemed obscene.

Is the legal system still bullshit? Yeah. Does this country have a warped sense of sexuality? Yep. But lolicon isn't illegal anywhere by a long shot.

No it's not. One prosecutor charged one man for it, and he plead guilty before the matter was even argued in court. There wasn't even a judge's ruling. In other words, there's no legal precedent. It's troublesome to say the least, but it's not a sign of any major legal shift. Stuff like this happens in bumfuck counties from time to time. There's also a Florida case against some hardcore pornographer that recently ended too.

You have to understand how and why he was charged. He was charged specifically for transmitting obscene material through federal post, ashcroft vs free speech coalition protected the artistic merit of pornography and made it hard for obscenity charges to be laid as broadly as feds would like them to be.

This sort of case is a classic example of how obscenity charges are still used today, when a prosecutor wants to charge someone with anything they will dig up obscure old laws like this that were never intended to be used this way. Usually this only happens to producers that the feds want out of business for other reasons (such as Max Hardcore) and it's curious that it was applied to a simple collector because he offended a postal inspector. Perhaps they really did consider it child porn, but couldn't charge him as such and applied their usual tactics.

If there is a lesson to be learned from this or an alarm to be raised it is to be careful what you send through the post. It seems like it's possible to offend people who you do not want to offend.

Yes that would be poor old Max, and he is a really great example of this. The feds got him by buying some of his titles, having them mailed to a community where it would be "obscene to the community standards" and have him charged in that county's court. It's plain fucking vanilla entrapment.
